New “stop” in the auction of a first home by a company repurchasing credits by the Financial Commissioner Pavlos Ioannou, for a loan for which an objection was pending for the rejection of an application in the Estia plan. The Commissioner states that, due to the unshakable facts of the case, he called the credit acquisition company for the immediate and unconditional cancellation of the planned sale for 22/08/2022 and the set aside of the sent type I and IA letters. He clarifies that “regardless of the fact that the sale in question was set for 22/08/2022, ie after the lapse of about three months from today, I nevertheless deemed its immediate cancellation, because, precisely, it is illegal. The letters “I” and “IA”, because they were sent prematurely, should be set aside. Under the circumstances, these letters sent prematurely may not have any legal effect, including the planned sale. “
The Financial Commissioner invites the borrowers in cases where the sale of their main residence is progressing while a decision is pending on their objection not to join the Estia plan to submit a specific complaint, following the legal procedures of the Office of the Financial Commissioner. This complaint must be accompanied by a certificate that it is the main residence, that the complainant's application for inclusion in the Estia project has been rejected, as well as a certificate that a decision on the objection is pending. “As I have already mentioned”, notes Mr. Ioannou, “the objections for non-inclusion in the Estia plan, which are being examined before the competent Ministry, seem to be around 1000, at least. I note in this connection the fact that a number of such complaints have already been lodged in my office, for which I am forwarding the relevant decisions. “
The Finance Commissioner concludes by stating that” I am unfortunately obliged to record the fact that before me and complaints about cases of realization, already, sale of main residence, pending application for non-inclusion in the Estia plan “.
