The Department of Lands and Surveys in collaboration with the Commissioner of Legislation, have prepared a draft bill entitled “The Law on the Management of Shared Buildings and Related Issues Law of 2022” which will govern the management and operation of common buildings.
The proposed bill sets out a regulatory framework for publicly owned buildings in the Republic regarding their management, supervision and proper operation. Essentially, it aims to solve a host of problems related to the management, maintenance and operation of common buildings. In particular, it aims to resolve serious issues such as the non-existence of a management committee, non-payment of utilities, insurance, partial or total destruction of the building, etc., which concern all owners of a shared building. The purpose of the bill is to give flexibility to management committees to be able to carry out their duties as unit owners are evading their responsibilities and many properties are not adequately maintained, with various security risks lurking.
Today the issue is regulated, no longer sufficiently, by Part IIA of the Law on Real Estate (Possession, Registration and Valuation), Chapter 224. The weaknesses and gaps observed during the implementation of the current legislation led to the need to create a separate service , responsible for overseeing compliance with the law, with the Department of Lands and Surveys being limited to issues of occupation and registration of jointly owned buildings.
In particular, the bill introduces the following:
Extension of scope, beyond the registered co-owned buildings, to all co-owned buildings which have obtained a building permit, division and approval certificate, but have not been registered in the real estate register and no separate titles of the units have been issued. (see article 4) Designation/creation of a Registration Service for Common Buildings and Supervision of the Operation of the Management Committees for the exercise of the responsibilities and powers defined in the proposed bill. (see Articles 5, 6 and 8) Extension of responsibilities and powers of the management committees (see articles 13-16) that must exist in all common buildings and operate on the basis of Standards or Internal Regulations.
The Registration Service of Common Buildings and Supervision of the Operation of the Management Committees, among others, will be responsible for:
Registration of co-owned buildings, as well as the mandatory registration of management committees in the Service, which maintains a register of co-owned buildings and management committees. (Articles 8-12) Adoption of Standard Internal Regulations for the regulation of the management of the owned buildings, as well as the definition of the rights and obligations of the owners, which will apply in case of non-issuance of regulations under the proposed law to regulate any issues . (Articles 18-20) Compulsory insurance of co-owned buildings and supervision for the compulsory insurance of units and co-owned buildings. (articles 24-27) Registration of the Common Buildings and the relevant Management Committee in a register that will be kept by the Service and regulation of their management. Defining the rights as well as the obligations of the owners of the units for the regulation of various issues. (Articles 9-15)
Additionally:
The Management Committee is empowered to make expenses that are reasonably necessary for the maintenance and proper operation of the common areas of the common building, which the owner neglects to pay. The method of cost allocation is introduced so that the proportion of costs for providing services is calculated based on the area of each unit. It is foreseen to carry out a study of suitability, static, mechanical and electrical inspection of each co-owned building by professionals registered in the Scientific-Technical Chamber of Cyprus and for purposes of ensuring the suitability of the buildings when and if deemed necessary by the Management Committee. The Management Committee can recover the amount owed by a lawsuit and at the same time register a real burden in the real estate of the neglected owner. (see articles 21-23) Provisions are introduced for the process of partial and total destruction of the unit or the co-owned building, as well as the interest of the owners of the units in case of destruction or termination of the co-owned building. (articles 28-32)
