Following the cancellation of the offer for public buses in Limassol, the offer was canceled for public transport in Paphos. Yesterday, the Administrative Court accepted the appeal of the company Paphos Transport Organization (OSYPA) and canceled the offer in favor of the Nicosia District Transport Organization (OSEL).
It is recalled that on 25.7.2021, the Ministry of Transport, Communications and Works announced two offers for the provision of public passenger transport services by buses to cover Limassol and Paphos. Bids were submitted by OSEL for both projects and OSYPA only for Paphos.

This was followed by a total of ten meetings of the Bid Evaluation Committee, which made a proposal for the award of both contracts to OSEL. The Tender Board, in a relevant meeting dated 10.2.2022, unanimously decided, as the recommendation of the Evaluation Committee, to award (and) the disputed contract to the interested party for the amount of € 54,000,000 plus VAT, with the right of the Contracting Authority to extend the services up to 50% in kilometers of Service for the amount of € 19,142,700 plus VAT. and reject the applicant's offer, due to a higher price offered by her. At the same time, the Tender Council decided to award the contract to OSEL and the Convention for buses in the province of Limassol.
The applicants alleged that the Ministry of Communications acted in violation of the Constitution, the relevant applicable law, regulations and procedure and/or in abuse and/or abuse of power and with a manifest error of Laws and Things, because, among other things, they and/or did not properly and/or did not evaluate at all the fact that the successful bidder, based on its founding and statutory document, could not and/or did not have legalization and/or did not have the legal capacity to bid in the contest to execute the public contract. Furthermore, there was no legal authorization for the persons who signed and submitted the successful bidder's bid.
It is recalled that another judge last month canceled the bid for the Limassol transport contract, accepting the above In its decision, the Administrative Court, after invoking the cancellation of the offer concerning Limassol, emphasizes that the award of the disputed contract for Paphos is canceled, as a result of error, since the interested party ( OSEL) lacks the required legal capacity to participate in the tender to claim the award of the (specific) Contract in question, which concerns the provision of Public Passenger Transport Services by Bus in the Geographical Area of Paphos. & Nbsp; & nbsp; & nbsp; & nbsp;/p>
