Consumers who buy remotely (via internet, telephone) have the right to cancel this purchase or to withdraw from the contract within 14 days, without any reason. The European Commission last week approved a reform of existing EU rules on the distance marketing of financial services to consumers, which governs financial services sold at a distance.
The proposal will strengthen consumer rights and promote cross-border provision of financial services in the single market. This market has evolved significantly in the light of the overall digitization of the sector and the new types of financial services developed since the rules were first introduced in 2002. These developments were further enhanced by the impact of the COVID-19 pandemic, which contributed significantly to the increase in online transactions. The proposal introduces actions in various areas:
Easier access to the 14-day withdrawal right for remote financial services contracts: in order to facilitate the exercise of this right, traders should provide a withdrawal button when selling electronically. In addition, the trader is obliged to send a notification of the right of withdrawal if the pre-contractual information is received within a period of one day before the conclusion of the contract.

• & nbsp; Clear rules on how and when pre-contractual information should be provided, as well as what information should be provided: the proposal modernizes the rules, for example with regard to electronic communications, requiring the seller to provide certain ex ante information, including, for example, the merchant's email address, any hidden costs or risk associated with the financial service. The information should also be clearly displayed on the screen, and rules should be established regarding the use of pop-ups or level links to provide information.
• & nbsp; Specific rules for protecting consumers when concluding financial services contracts online: Financial service contracts can be complex and therefore difficult to understand, especially if they are traded remotely. The proposal obliges marketers to create online systems that are fair and transparent, and to provide adequate explanations when using online tools (eg automated tips or chat windows). The rules also empower the consumer by introducing the possibility of requesting human intervention if the interaction with these online tools is not fully satisfactory.
• & nbsp; Enforcement: the proposal will strengthen the competent authorities. Stricter sanctions will be imposed on financial service contracts concluded remotely in the event of widespread cross-border infringements, with a maximum penalty of at least 4% of annual turnover.
• & nbsp; Full harmonization to ensure the same high consumer protection throughout the internal market: the proposal introduces full legal harmonization, establishing similar rules for all providers in all Member States.
