Efstathiou: Judicial decisions to ensure human rights

Judicial decisions and their interpretations, "irrespective of their origin, must ensure the maximum and most effective protection of human rights and ultimately dominate and prevail over any other limited legal interpretation" said the independent member of parliament, Kostis Efstathiou.

According to an announcement by the Parliament, Mr. Efstathiou, in the context of the work of the 2nd Part of the 2023 Session of the Parliamentary Assembly of the Council of Europe (PACE), participated in a discussion in Plenary, on the subject of the European Convention on Human Rights and national constitutions.

In his intervention, the Cypriot MP said that “regardless of any formal hierarchy between the European Court of Human Rights, the Court of the European Union and the national supreme courts, it is understood and accepted that the principles of effectiveness, subsidiarity and proportionality are which determine the effective protection of human rights”.

He also pointed out that “the multi-layered dimension of the existing legal frameworks should not allow member states to evade their obligations or to interpret the rules of law in a way that which hinders the dynamic development of the legal establishment of the protection of human rights”.

On the contrary, said the Cypriot MP, “judicial decisions and their interpretations, regardless of their origin, must ensure the maximum and most effective protection of human rights and ultimately to dominate and prevail over any other limited legal interpretation”.
