The need to start a discussion on the issue of abusive clauses for the protection of borrowers, was raised on Tuesday by the MP of the Movement of Ecologists-Citizens' Cooperation, Stavros Papadouris, who registered an ex-officio issue of Energy, Trade, Industry and Tourism.
In statements after the meeting of the Commission, Mr. Papadouris said that he registered an ex-officio issue for abusive clauses, “as a result” of a recent decision of the EU Court, which concerns abusive clauses.
He said that it is “a big chapter, timeless in Cyprus “and expressed the hope that it will be discussed immediately.
“We thought that with this decision, a chapter of discussion should be opened so that we can finally see how the state protects consumers (borrowers), in the matter of abusive clauses,” he added.
He referred to a recent decision dated 17 May, 2022, which, he said, “is clear in what it proposes, ex officio to the judges of the district courts.”
He expressed the hope that both the Supreme Court and the Attorney General will proceed with instructions to the district judges, where they identify issues of abusive clauses, ex officio, to proceed to review the contracts, and to base their decisions on this review, which, logically, they would have done.
Answering a question, What does an ex-officio investigation by judges mean, Mr. Papadouris, that if, for example, the two parties do not claim that there is an issue of abusive clauses, the Court's decision clearly states that throughout the trial, if if the district judge finds that there is an issue of abuse, then he must raise it and take it into account in the decision he will make, completely ex officio without even being asked.
