As “illegal”the Supreme Court recently ruled on the continued detention of a 22-year-old asylum seeker from Syria, who was arrested in September 2021 after arriving in Cyprus after authorities found posted on his social media profile < strong>photo of him with a gun and military clothing, with emblems of terrorist organizations.

Specifically, the Supreme Court ruled that “set aside” a first-instance decisionwith which the appellant's request for habeas corpus was rejected, since the authorities did not justify his detention exceptionally for reasons of national security or public order. The 22-year-old entered the areas controlled by the government of the Republic of Cyprus through the occupied in August 2021 and subsequently submitted a request for international protection. “Only because of his status as an applicant, his detention was not permissible”, the Court reports, however, a detention order was issued against the detention order, pursuant to Article 9F(2)(e) of the Law, which exceptionally allows the detention of an applicant “when required to protect national security or public order”. The reason, as reported, was related to the fact that the Police found that the appellant had posted on his Facebook profile a photo holding an automatic weapon and wearing a military outfit, with the emblems of the terrorist organizations ISIS and Jaysh al-Ahrar.

The appellant, according to the decision, argued that his detention became illegal due to its long duration, with the trial court rejecting his request for habeas corpus last July, considering that the continuation of his detention is linked to the completion of the proceedings, which he has raised, in the context of his request to be granted international protection, and considered that the 10-month period (then) had expired, given that the appellant would be invited for an interview within of the following days, did not warrant court intervention to release him.

It is reported that the appellant argued that he had posted the photo at 17 “in a moment of immaturity”, and that it has nothing to do with terrorism. He said that he bought this weapon when he was “underage and immature” and that this is done by many minors in Syria during the last years of the war, since the weapons are in high demand and easy to obtain. refers to the decision.
