An application to the Supreme Court & nbsp; was submitted today by the Audit Office regarding a & nbsp; circular of the Ministry of Finance “by which it was determined that the titles of the latter in the Legal Service, the Audit Office and the General Accounting Office will not be those provided in the Constitution and the Budget Law “. In a statement, the EV states that it requests a & nbsp; statement from the court that the circular in question is already invalid and without any absolutely legal effect.
As the EV explains, on April 19 the Ministry of Finance & nbsp issued a circular to the wider public sector, stating that the titles of the latter to the Legal Service, the Audit Office and the General Accounting Office will not be those provided for in the Constitution and the Budget Law. As for the Assistant Auditor General, in the circular his title is changed to “Assistant Auditor General”.
As he notes, the Advocate General's opinion had preceded on March 24, who, “voluntarily, overturning the opinion of his predecessor given in 2015, called on the Chiefs of the three influential officials to use the titles he had determined, instead of the on the grounds that there is a contradiction between the Greek and Turkish texts of the Constitution “.
In the view of the EY:
The Ministry of Finance is deprived of the competence and/or authority to issue the said circular, nor can it use a circular or otherwise to determine the title of the second-class institutional official of the Audit Service. The issuance of the circular constitutes a constitutional diversion and/or & nbsp; abused and/or & nbsp; is contrary to the express provisions of Articles 58.2, 115 and 117 of the Constitution as well as the Law on Budget. & nbsp; The Ministry of Finance, neither voluntarily, nor after the opinion and/or urging of the Attorney General, has no constitutional or other authority to interpret constitutional issues and/or resolve alleged contradictions between the Greek and Turkish texts of the Constitution, something which falls under the exclusive jurisdiction of the Supreme Court under Articles 149 and 180.2 of the Constitution. “We regret that an issue which, in the eyes of the people, justifiably seems to be of little importance, has been raised by some to a question of the powers and powers of second-class independent officials. But if it has been raised as such, we are obliged to ensure that any regulation is compatible with the Constitution, something for which the Supreme Court has exclusive jurisdiction. any other statement, written or oral “, adds the EV in its announcement. & nbsp;
