Ministry of Labour: Non-payment of 13th salary is a criminal offence

The Ministry of Labor and Social Insurance in its announcement points out that the 13th salary, where it is paid in the context of a collective agreement or a personal contract or as a practice of the company, it constitutes part of the employee's salary and therefore its non-payment is equivalent to a violation of the provisions of the Protection of Wages Law.

This, he adds, in addition to the rights that the Law provides to the employee to claim his payment civilly, it also constitutes a criminal offense and has as a consequence the criminal prosecution of the employer. According to the provisions of the aforementioned Law, in case of conviction of the employer, a prison sentence of up to 6 months or a fine of up to €15,000 or both penalties are imposed.

In addition, the competent Court can award the employees the amounts owed to them corresponding to the 13th salary.
