Now corrects former Attorney General: Assistant Auditor General to be listed as Assistant Auditor General

The Attorney General Mr. George Savvidis in his opinion set aside the opinion of the former Attorney General Mr. Costas Clerides regarding the correct wording of the titles of officials provided for in the Constitution of the Republic of Cyprus. Specifically, Mr. Savvidis adopted the opinion of the late Attorney General Michalakis Triantaphyllides, dated 22/2/1990, substantially upgrading the position of officials bearing the title “Assistant”. This development can not please the Auditor General Mr. Odysseas Michailidis, who in the recent past insisted that the correct wording of the title for the second class in the Audit Office is “Assistant Auditor General” and not “Assistant Auditor General”. It is well known that Odysseas Michailidis is at the knives with the assistant general auditor Mr. Kyriakos Kyriakou. In an opinion dated 9/7/2015, the former Attorney General, Mr. Costas Clerides, ruled that the Auditor General is right to want Mr. Kyriakou to be the Assistant Auditor General. In fact, when this was attempted in the past to be changed by a bill, there was a reaction from the auditor general. Finally, Mr. Clerides's opinion was set aside by the current Attorney General and with a circular the day before yesterday in the public and wider public sector, all state and elected officials as well as the heads of departments and services are called to make a correction.

The Circular

The circular issued by the Director General of the Ministry of Finance Mr. George Pantelis on 19/4/2022 states verbatim: “I inform you that the Attorney General of the Republic with an opinion dated 24/3/2022 revised the opinion of the former Attorney General Mr. Costas Clerides, dated 9/7/2015 regarding the correct wording of the titles of officials provided in the Constitution of the Republic of Cyprus following the opinion of the former Attorney General Michalakis Triantaphyllides, dated 22/2/1990. In particular, the opinion of the Attorney General of the Republic, who interprets the Constitution and the case law extensively, concludes that the correct wording of the titles of the mentioned officials is as follows:

  • Assistant Attorney General of the Republic instead of Assistant Attorney General of the Republic.
  • Assistant Auditor General of the Republic instead of Assistant Auditor General of the Republic.
  • Assistant Attorney General of the Republic instead of Assistant Attorney General of the Republic.

At the end of the circular of Mr. Pantelis, the general directors of the ministries and the sub-ministries are called to inform the members of the public service as well as the members of the Police, the Fire Brigade, the army and the educational service, so that uniform wording when using the titles of the above officials in all official documents, relevant correspondence and in all relevant laws.

How Odysseas Michaelides reacted

< p>“The titles of all positions are defined in the Constitution and the Budget Law, and not in circulars of the HR that does not have such authority,” the Audit Office said in a post on Twitter. It adds that “as the body responsible for auditing the final budget report, it is examining the matter and will make its decisions public.”

Ο Auditor General Odysseas Michailidis, in his own tweet on his personal account, points out that “what is being attempted today by the General Assembly, without even having such power, the Parliament rejected it in 2015, characterizing it as a constitutional diversion. “Unfortunately, the distorted title is used by some to distort the provisions of the Constitution as well as their powers.”
