The contested decision was annulled, with OKYpY being asked to pay an amount of €1700 to cover the awarded costs
The State Health Services Organization (OKypY) hired for the position of senior legal officer, a person who sent an application-resume in order to be hired three days after the last date for submission of applications set by the organization.
This is a First Appointment position, where according to the relevant announcement, the annual salary amounts to €57,696.21, including the 13th. As stated in the decision of the Administrative Court, by which the decision to appoint Ms. A.S is annulled, “on 7.8.2020 a notice was published in the Official Gazette of the Republic announcing a position for the first appointment of a senior legal officer with the last date for submitting applications on 28.8 .2020 and time 14.30. The DP's application was received late on 31.8.2020”.
The decision was issued following an appeal by Augusta Fakontis against OKYpY, with the Administrative Court concluding on March 19, 2024 that the appeal succeeds and the challenged decision is annulled, with OKypY being called as pay an amount of €1700 to cover the awarded expenses.
It is worth noting that the appointment decision of Ms. A. S. includes a provision that, “if the appointee does not meet the necessary conditions to take the position, the Commission will offer the position to Ms. Augusta Fakontis”.
