The Plenary Session of the Parliament unanimously passed two laws concerning the operation of insurance companies in the Republic of Cyprus.
The first law preserves the proper functioning and stability of the insurance market, after the withdrawal of the United Kingdom from the European Union (EU), as well as the protection of the beneficiaries under insurance contracts.
Following the withdrawal of the United Kingdom from the EU, a legal vacuum arose in the operation of British insurance companies operating in the Republic of Cyprus under the freedom to provide services, due to the non-inclusion of insurance and financial services in the UK exit agreement. .
The proposed arrangements ensure the uninterrupted service of the customers of the mentioned companies, the fulfillment of the existing obligations, as well as the management of their portfolios.
The second law, which was passed unanimously, aims to improve the process of liquidation of an insurance company in case of revocation of an insurance license.
It is clarified that the revocation of an insurance company license by the Insurance Superintendent, in case the company uses its license within twelve months or explicitly renounces the license or ceases to operate for a period longer than six months, does not lead to the compulsory dissolution and liquidation of the insurance company.
Even if in which an insurance undertaking carries on business and the license to hold such business is revoked, then this entails the compulsory dissolution and liquidation of the business by the court.
Finally, the provisions of the basic law which provided for the transfer of a portfolio do not apply in the case of revocation of an insurance license.
