Bills concerning the possibility for issuers of corporate bonds to benefit from a reduced withholding fee for the defense, the imposition of a guarantee fee on a credit institution and the possibility for the Hellenic Capital Market Commission to extend deadlines to its supervisory committee. Specifically, the Parliamentary Finance Committee continued the debate on the principle of the bill concerning the extension of the framework for withholding an extraordinary contribution from interest receivable from corporate securities, in order to benefit from the reduced rate of 3% and corporate investors, other than individuals.
During the discussion, the only suggestion accepted by the Ministry of Finance was that of the Stock Exchange, which referred to the need to deduct foreign government bonds from the reduced rate of special contribution for defense through the deletion of the word in the bill “or Government of another state “.
The Office of the State Aid Supervisor, the Legal Service, the Tax Department and the Association of Certified Public Accountants of Cyprus (SELK) agreed with the proposal of the Ministry of Finance.The Association of Banks' proposal to expand the framework so that entities that issue corporate bonds for supervisory purposes are entitled to a reduced rate was not accepted as it was considered that it would be indirect state aid to these entities.
The representative of the Association Banks expressed the view that “it is an unfavorable distinction between large and small issuers of securities to be a condition to be listed” securities.
A representative of the Central Bank stated that the CB will continue to exercise its responsibilities, ie to supervise the credit institutions to comply with the capital requirements and on the other hand what responsibilities it has in relation to the disposal of bank bonds, while noting that the CB did not has responsibility for taxation issues “.
Also, the Finance Committee of the Parliament continued the debate on the principle of the bill regarding the imposition of a guarantee fee on a credit institution that benefited from the deferred tax claim created by tax losses.
According to the changes made on of the original bill, the acquiring credit institution pays to the Republic the annual guarantee fee for each tax year from 2022 onwards to which the annual installment corresponds. The annual guarantee fee is set by the Minister of Finance 1.5% of the result resulting from the multiplication of the tax rate with the relevant annual installment with a maximum amount of 10 million euros.
The bill also states that the fee is notified to the credit institution within six months from the end of each relevant tax year and will be paid within nine months from the end of each relevant tax year.
The representative of YPOIK stated that from 2022 by 2028 it is estimated that the state will receive 5.35 million euros per year, an amount that is notified to the credit institution within six months.
He also stated that from 2018 to 2021 the state is expected to receive the amount of 21.4 million euros in 2022 and added that “within the year in which this paragraph enters into force, a guarantee fee of more than 10 million euros can be set. He also said that the deferred liability is 417 million euros and if an annual guarantee fee of 1.5% is calculated, then an amount of 6.25 million euros will be received which the state would receive in depth 11 years (from 2018 – 2028).
Finally, the Finance Committee decided to approve the possibility, only once, of the Hellenic Capital Market Commission to extend & nbsp; in cases where the conditions prevailing in the Republic affect the ability of its supervisors (Open Form Collective Investment Agencies, Alternative Investment Agencies) to comply with any of the deadlines set in the respective basic legislation.
Of Finance of the Parliament continued the debate on the issue after the postponement of its debate in the Plenary Session of the House on April 14, 2022.
