Responsibilities to doctors and hospital for cataracts

Exactly one year later, the Police investigations were completed in the case of the infection of eight patients with the powerful bacterium pseudomonas, after cataract surgery in a private hospital in Nicosia, as a result of which the five lost one eye.

Information of “F” states that investigators of TAE Nicosia who investigated this serious case, are preparing their final report and, unexpectedly, early next week will hand over the bulky file to the Legal Service. According to the same information but also from legal sources, it seems clear from the actions of the Police to receive investigative testimonies from persons considered to be involved, that in their report the investigators will place responsibilities on doctors as well as on the hospital.

It is noted that the final decision on whether the case will be brought before Justice will be taken by the Attorney General, after studying all the evidence in relation to documents and other evidence in the file. Two people have been summoned for questioning as suspects.

The case was reported in October 2020, when ten patients underwent cataract surgery on the same day at the same hospital. Eight of them were infected with the bacterium, while the other two were not. In fact, one of them later lost his life and recently a second, without being attributed as a side effect of the infection. Investigators for a full and extensive investigation of the case had requested the assistance of the Ministry of Health to conduct an investigation into the incident. When the first report was submitted, the ministry asked for a second one as it was not considered that the first one covered all the issues.

Also, the Police, in an effort to investigate all aspects of the case, went abroad to collect testimony and expertise. A decisive element that seems to judge the possibility of criminal liability, are the consumables used during the surgeries and in general the environment that existed in the operating room.

Testimonies were taken from both patients and their relatives, while a report was prepared by the Labor Inspection Department.

It is reported that when the infection occurred, the eight patients were transferred to an ophthalmology center and a private clinic for treatment, while they were then transferred to Makareio Hospital and the most serious cases to the General Hospital of the capital.
