A new effort to correct the distortion that has existed since the time of the Troika, when the actuarial reduction of 12% for retirement at the age of 63 was decided, is being made by the government, after a relevant consultation with the former Minister of Labor Zeta Emilianidou with the Labor Committee of the Parliament.

Specifically, yesterday a new bill was submitted that ensures the right to a sickness allowance for people over the age of 63, who do not apply to receive a statutory pension, although they establish this right. As a result, quite a few people who happen to get sick or injured are essentially forced into early retirement and penalized with the corresponding reduction that occurs before retirement at 65.

We remind you that to deal with the distortion that exists today, as many people who reach the age of 63 continue to work either because they want to or because they do not want to receive a reduced pension, but without being entitled to a sickness benefit if they fall ill, a similar attempt had been made in the past, but without a successful outcome.

In particular, the government tried at the end of 2020 to correct the existing problem, however, the relevant bill it had submitted was amended by the Parliament, so that those who continue to work after the age of 63 are also entitled to unemployment benefits. The government had then disagreed with the amendment of Parliament, made under its previous composition, and referred the law, however, the referral was rejected. As a result, and as recorded in the introductory report that accompanies the new bill that was submitted to the Parliament yesterday, the President in June 2021 addressed the Attorney General of the Republic, requesting “to register on his behalf a Petition to the Supreme Court, in accordance with Article 140 of the Constitution, since there is incompatibility with the Constitution of the Republic of Cyprus, in particular in relation to articles 28.1 and 80.2, as well as with the Principle of Separation of Powers”.

With the report that was then made to the Supreme Court, the government's proposals did not come into effect, nor what the Parliament had voted for, with the result that the problem continues to exist and even intensified during the peak of the pandemic. The issue, as mentioned in the introductory report of the new bill, which attempts to amend the Social Insurance Law, was discussed in recent sessions of the Parliamentary Committee on Labour, Welfare and Social Insurance, during which the Committee – under its new composition – requested that the bill in question – for which reference was made to the Supreme Court – “be resubmitted to the Parliament for a vote, just as it was legally checked by the Legal Service and submitted on 30.11.2020 by the Ministry of Labor and Social Insurance for a vote, according to analogy with the procedure followed for the re-filing of the Minimum Guaranteed Income and More Generally Social Benefits (Amendment) Law of 2022, regarding the assessment of Persons with Disabilities, while the relevant Reference of the President of the Republic to the Supreme Court was pending” .
