– Customer has paid two installments before submitting and approval of his request. What applies depending on the following cases?

A. Customer did not request the retroactivity and additionally asked the bank to consider these installments as prepayment.

In the event that the customer has not requested retroactivity, the installments, according to the basic decree, remain as payment against the contractual installments for which they were paid, therefore they can not be considered as prepayments. In this case, the client, if he belongs to the categories of the new decree, will be entitled, in case of interest, to a further suspension for two months.

B. A customer did not request the retroactivity and also did not ask the bank to consider these two installments as a prepayment. As a result, the customer will be entitled to express interest in suspension, according to the new decree for the remaining period of 9 months.

In this case, the client, if he belongs to the categories of the new decree, will be entitled, in case of interest, to a further suspension for two months.

C. The client asked for a refund and the money of the two installments he had paid was returned to him.

In this case, the client has benefited for 9 months in full and is not the beneficiary of the new suspension plan.

– A client has multiple loans, current and credit card and has fully benefited from the 9-month suspension period but only for one of his loans (as he had applied and approved only for a specific loan).

In this case, if the client and his credit facilities for which he did not already benefit from the previous suspension of installments and interest and are covered by the categories of the new decree will be entitled, in case of interest, suspension for 6 months.

– Small and medium enterprise maintains loans which are secured by multiple mortgages in the main residences of its shareholders. What applies depending on the following cases?

A. The small and medium enterprise whose operations are subject to mandatory suspension by decree or is active in the hotel industry, maintains a business loan / loans secured by multiple main residences, each with a market value of over and under € 350,000 .

The parameter of the market value of the main residence up to € 350,000 does not apply to the categories of business loans of companies that have been suspended due to the decree dated 8/1/2021 and companies in the hotel industry.

B. The small and medium enterprise whose operations are not subject to mandatory suspension by virtue of the decree or is active in the hotel sector, maintains a business loan / loans secured by multiple main residences, each with a market value of more or less than € 350,000.

The loans are eligible for suspension, which are secured by a main residence with a market value of up to € 350,000. In the case of loans with multiple collateral of main residences will be eligible the loans whose all main residences do not exceed € 350,000. In the event that one of the collateral (main residence) exceeds € 350,000, the loan in question is not eligible for suspension.

– What applies in the case of a loan with an annual installment that fell within the period of suspension of installments and interest of the year 2020 and suspended the annual installment?

In this case the client has benefited for 9 months in full and is not a beneficiary of the decree.

– A catering company, which maintains a business loan and based on the decree of the Ministry of Health on January 8, 2021 can continue home delivery services and / or take away package can take part in the new decree?
