The specific “small quantities” are defined in the draft legislation as follows:

• For home-made products of plant origin, a quantity not exceeding five thousand kilos (5,000 kg) or five thousand liters (5,000 L) per year, as the case may be, and, in particular for wines, a quantity not exceeding three thousand liters ( 3000L) per year and for zivania a quantity not exceeding one thousand liters (1000L) per year,

• For handicraft products of household activity, a number that does not exceed fifty (50) pieces per day.

• For domestic animal products, in terms of poultry, rabbits and pigeons, products based on raw milk, fresh fishery products and snails, the quantities defined in Regulations 401/2013.

• For raw cold cuts, quantity not exceeding fifty kilos (50kg) per day.

At home but with a label

With the framework that will be created, although the home-based industry and the production of products will be legalized, even in houses in the mountains, at the same time conditions are set in this direction. These are the ones that are related, among other things, to hygiene issues. In addition, the food must be labeled, “labeled” in particular, which according to the bill means “reference, indication, trademark, image or symbol, which refers to food and is packaged, document, plate, label, a ring or collar, which accompanies or refers to that food and includes a reference to the food ingredients and the dates of manufacture and expiry '.

The bill also defines the definition of handicraft activity, recording as such the activity that includes the production from processing, labeling and direct disposal of small quantities of handicraft products. The home-made products concern, among other things, home-made products of plant origin, honey products and home-made animal products, the primary ingredient of which is Cyprus as a country of origin or place of origin, as well as handicraft products of home-made activity.

Agricultural products of plant origin are defined as: Vine products, including wines, zivania, soutzoukou, kyofteri, palouze and bake, spoon sweets, jams, rose products, olive and olive oil products, except olive oil products, pastries and pasta, locust bean products, honey and / or nuts products, fig products and dried fruits and herbs.

The conditions

Based on what is being promoted, before the start of operation of a technical installation will be required the registration in the Register of Technical Installations that will be kept by the Cyprus Standardization Organization. However, the household installation that will be registered in the register may have household products with the individual registration number, if it meets certain conditions. These, in addition to the entry in the register, include, inter alia, the following for household facilities:

• To comply with the provisions of the existing legislation of the Republic and the European Union for the production, processing, packaging, distribution, distribution and exhibition of household products,

• The labeling of home-made products of animal origin and home-made products of plant origin to be in accordance with the provisions of the KDP Regulations. 401/2013 or the Regulations K.D.P. 307/2009, depending on the case and the Law on Food (Control and Sale) and the Regulations and Decrees issued under it and the directives or regulations or decisions of the European Union that are in force.

• In the case of home-made products of household installation, which is registered in the Register of Household Facilities of Animal Household Products or in the Register of Household Facilities of Household Products of Plant Origin and Household Products from honey, there is full compliance with general health and safety requirements. in the Instructions of Good Hygiene Practice for Home-Technical Facilities issued by the Director of Veterinary Services or the Head of Health Services of the Ministry of Health under the provisions of this Law.

From the above, it follows that important parameters for the implementation of the law that is being promoted will be clarified with relevant instructions that will be issued later. As stated in the legislation itself, “each competent authority, depending on whether the home-technical installation is registered in the Register of Household Facilities of Animal and Household Products or in the Register of Household Facilities of Household Products of Plant Origin and Household Products from Honey or House Products, may issue instructions, after prior public consultation, which define the details and specify the manner of application of the provisions of this Law and which are binding and mandatory in terms of their application to the persons to whom they are addressed “.

These guidelines may regulate in particular the regulation of procedural and technical matters, good hygiene practice for household facilities, the adoption of training programs for facilities in basic food hygiene, the adoption of aid schemes, sponsorships, benefits or incentives for household setting deadlines and imposing administrative fines for infringements.

Household register and mandatory registration

According to the law, the purpose of the law, prepared in collaboration with the Ministry of Energy, the Ministry of Tourism, the Commissioner for the Development of Mountain Communities and other co-competent ministries, is to “define the terms and requirements of production conditions for the mandatory registration of home-technical facilities in a relevant register that will be operated and maintained by the Cyprus Standardization Organization (CYS).

The purpose of keeping the Register is the mandatory registration of all household facilities that meet specific conditions and the observance of all necessary information for decision-making, their financial support and policy, as well as for any other legal use by the Competent Authorities and by other co-competent bodies. According to the Ministry of Commerce, with the institutionalization of home-made small units that carry out their work from home, by registering in the register, they will be able to secure sponsorships and sell their products in the retail market, something that is estimated to help development of entrepreneurship in rural areas, especially in the fields of traditional products, but also in retaining and attracting population, mainly in mountainous areas.

Fines for violating the law

With regard to fines, the legislation provides, inter alia, that “a person who operates a plant for the production, processing or distribution of household products that is not registered in accordance with this Law, is guilty of an offense and, in case of conviction, is subject to a fine not exceeding one thousand euros (€ 1,000) “. The legislation also stipulates that “a person who, after being notified by the Cyprus Standardization Organization (CYS) or by a Competent Authority, refuses, omits or neglects to fulfill obligations arising under the provisions of the Law and the Directives issued under it, is guilty of a crime and, in case of conviction, subject to a fine not exceeding one thousand euros (€ 1,000) “.
