At the same time, the deputies passed a law by a majority to amend the Law on Courts, in order to eliminate the first instance jurisdiction of the Supreme Court and the district courts regarding the adjudication of maritime cases and their adjudication to be under the jurisdiction of the Maritime Court. Previously, a majority of MEPs voted against an ELAM amendment that eliminated the possibility of using the English language in these two courts. This possibility is given after the amendment of the Constitution that was voted by the Plenary in its previous session.

The Commercial Court will be composed of five judges and will have jurisdiction over commercial disputes. The Maritime Court will be composed of two judges and will have jurisdiction over maritime litigation. million.

The qualifications of the judges of each court are defined as a very good knowledge of the English language. It is also possible to conduct the proceedings and to register the documents in English, when the interest of the court so requires and at the request of one of the parties.

As regards the Commercial Court, the exemption from the jurisdiction of the claim or counterclaim in relation to banking and/or financial matters, but also the registration of an arbitral award in respect of banking and/or financial institutions.

It is also provided that commercial disputes concerning a dispute or issue arising out of or relating to the application of its provisions on Compensation Laws for Infringements of Competition Law, intellectual property and related rights matters and arbitration matters shall fall within the jurisdiction of the Commercial Court, independently the amount of the disputed amount or the value of the dispute in question.

ELAM MP Sotiris Ioannou, explaining the ELAM amendment, called on the parties that voted against the amendment of the Constitution of the Republic of Cyprus in the previous plenary session, to vote in favor of the party's amendment to remove the use of English/from the English language. p>

AKEL MP Aristos Damianou pointed out that the Plenary Session was placed on this issue in the previous session.

DIKO MP Panikos Leonidou stated that if the amendment of the Constitution was not published in the official newspaper of the government, which means that the specific provision in the bill that refers to the use of English language will be unconstitutional.

His MP DISY Haris Georgiadis expressed the view that there is no obstacle, since both the bill and the constitutional amendment are valid when they are signed and published in the newspaper, something that, as he said, is expected to happen at the same time.

EDEK MP Kostis Efstathiou asked for the position of EDEK to be recorded that a law like the constitution begins to take effect from its publication in the official newspaper of the democracy. In any case, he added, EDEK will vote against this legislation.

The Chairman of the Legal Committee, DISY MP Nikos Tornaritis said that the creation of the two courts is an innovation in civil jurisdiction in Cyprus. He added that it will contribute substantially to the speedy adjudication of commercial cases and will strengthen the competitiveness of Cyprus as a center for the provision of high quality services and to attract new investments in the very turbulent economic environment we live in today. He also said that the two courts play an important role in the medium-term economic development of the country, while he is expected to at least contribute to tackling the problem of backlogs, something that will happen if the wider justice reform proceeds.

<p DIKO MP Zacharias Koulias said that he never imagined that after the British occupation, the Parliament would decide to change the language of the court for profit. He spoke of a tragic national error that the place would be called upon to pay for.

Mr Tornaritis said that they did not change the language, but only the right to use English was given, when and if party, as was done in other countries such as France.

Mr. Efstathiou stated that EDEK voted against because in France the Constitution was not amended to allow English through the back door
