The law passed by the Parliament in 2021, which introduced the term “employee” and affects hundreds of employees, did not create a new category of employees, nor did it establish a new right, the plenary of the Supreme Court states in its decision on the Petition of the President of the Republic .
According to the Supreme Court, any employment, under such circumstances from which the existence of an “employer-employee relationship” can be inferred, still exists as the dominant element of the provision in question. The same applies to employment under the “purchase or provision of services or any other employment contract”, regardless of its characterization, provided, however, that there is, in essence, a genuine relationship between employer and employee. & Nbsp;
The Court held that the amending Law is essentially intended to explicitly include the term “employee” for social security purposes, or employment under a service contract or any other relevant contract, regardless of the designation attributed to such contract (and employer – employee) in order for employees to have all the rights and benefits, including the payment of their social insurance as employees and not as self-employed. & nbsp;

The plenary session of the Supreme Court agreed with the positions of the Member of Parliament (the law firm Andreas S. Angelidis DEPE) after concluding that the amending Law is not contrary to or incompatible with European Law (Directive 2014/24/EU), the Constitution of the Republic of Cyprus (Articles 80 (2), 122, 125 (1) of the Constitution) and the Principle of Discrimination of Powers and therefore may be issued. In particular, the Court ruled that the Law created a new category of insurable employment without entailing an increase in state expenditure, since it is clear that the existence of a “relationship between employee and employee”, the existence of an “employer-employee relationship”, regardless of characterization, remained. & nbsp;
The Director of Social Security Services is responsible for resolving issues related to whether a person is employed or self-employed and his decision can be challenged by submitting a hierarchical appeal to the Minister of Labor and then with an appeal to the Court.
