The Plenary Session of the Parliament convenes today as an emergency – One impeachment and three reports from the PtD
Today at 11.30 am extraordinarily the Plenary of the Parliament > of the Representatives after the impeachment of law on the Collective Management of Intellectual Property Rights and Related Rights.
The President of the Republic, Nikos Christodoulidis, sent< /strong>the law “on the Collective Management of Intellectual Property Rights and Related Rights as well as on the Granting of Multi-territorial Licenses for Online Uses of Musical Works”, which was passed by the Parliament in its last plenary session before the summer shutdown on July 11.
At the same time, the President proceeded to directly report to the Supreme Court three laws passed by the Plenary.
The law referred to refers to an amendment to the legislation that was passed following a law proposal by DISY Member of Parliament Kyriakos Hatzigiannis and aimed at improving provisions regarding the imposition and collection of fees by collective management organizations and independent management entities and regarding the exercise supervision and controls by the Intellectual Property and Related Rights Authority. The law was deemed necessary since it was considered that creators and artists did not receive money for their intellectual work.
In the reasons for the impeachment the President mentions the incompatibility of the law with EU law, with the principle of separation of powers and with articles 1A, 23, 25, 26, 28, 61, 80, 167 and 179 of the Constitution.
An extraordinary session of the Parliamentary Trade Committee on the same issue has been set for 09.30 in the morning. The Attorney General of the Republic Giorgos Savvidis and the Minister of Energy, Trade and Industry Giorgos Papanastasiou have been invited to attend the session.
At the same time, the President of the Republic proceeded to refer to the Supreme Constitutional Court three laws passed by the Plenary, raising issues of unconstitutionality, violation of the separation of powers and European legislation.
The first law concerns the Invalidity of State Officials, which was passed following relevant proposals for a law by the Parliamentary Institutions Committee.
The President reported to the Supreme Constitutional Court a law introducing further regulations to the National Solidarity Fund (ETA) for unemployed depositors. The law was passed following a law proposal by DISY Member of Parliament Averof Neofytou.
Also, the President of the Republic proceeded with a reference to the Supreme Constitutional Court of “On assessment of the Impact on the Environment from certain projects amending the law of 2024” since it was considered contrary to the principle of separation of powers, European directives on services in the internal market but also the assessment of the impact of public and private projects on the environment. It was also held to be contrary to Articles 1A, 61 and 179 of the Constitution.
The petitions have been fixed for directions by the Supreme Court on September 4.
