The Radio and Television Authority determines that candidates have exceeded their advertising time

The number of radio and television organizations, during the current pre-election period, have broadcast “political advertisements”, without the prior notification of the Cyprus Radio and Television Authority, the Director of the Cyprus Radio and Television Authority Neophytos Epaminondas states in his letter

Potential excess of advertising time that each candidate is entitled to in relation to political advertisements for the European elections, the Radio and Television Authority states, urging those involved to apply the legislation.

In a letter to Directors of radio and television organizations, candidate staffs and the Commissioner of Elections, the Director of the Cyprus Radio and Television Authority, Neophytos Epaminondas, notes that the Cyprus Radio and Television Authority has established that a number of radio and television organizations, during the current pre-election period, have broadcast “political advertisements”, without the prior notification of the Cyprus Radio and Television Authority, with the result that phenomena of possibly exceeding the advertising time to which each candidate is entitled [within the meaning of article 34D of the Law on Radio and Television Organizations 7(I)/98 (as subsequently amended)] and require the intervention of the Authority to terminate further transmissions.

The Authority recalls that article 34D of the Radio and Television Law 7(I)/98 (as subsequently amended) provides, among other things, that the television or radio organization broadcasts political advertising under the same financial or other conditions for all candidates in the case of presidential elections and for all candidates in the case of parliamentary or European Parliament elections, as the case may be, but also that every television or radio organization before the transmission of any political advertisement has the obligation to immediately notify the Authority of the agreement for the transmission its content, as well as its transmission time.

In addition to the above, the Authority reminds all candidates that based on article 34D(4) of the aforementioned Law “Candidates in the case of presidential elections and candidates in the case of parliamentary elections or European Parliament elections or the independent candidate , depending on the case, must, five days before the broadcast of the first political advertisement, submit to the Authority the program of registration and broadcast of their political advertisement agreed with the television or radio organizations”.

It is clarified that based on article 34D(7), “candidate” in the case of European Parliament elections, means a person who submits a candidacy based on the Law on the Election of Members of the European Parliament in the event that this person is exposed to the election individually, or the combination of a party or the combination of a coalition of several collaborating parties or the combination of independents when the candidates based on the Law on the Election of Members of the European Parliament are exposed or are about to be exposed to the election in combination.

The Authority also informs the involved that it has at its disposal the 24-hour recording and archiving system of broadcasting organizations IRIS, and can ascertain at any time whether the broadcasts of broadcasting organizations are within the legislative framework, indicating that failure to comply with the content of this circular entails the taking of measures and the possible imposition of the corresponding sanctions, in accordance with the provisions of the Legislation.
