ΑυτΕς εΙναι οι &pi νεδσικεσθασμ ;δοννοασηκοσ ></p> <p>Cases with political, economic and social impact are expected to be decided within the next judicial year, which officially begins in September. p> </p> <p>The next period is awaited with great interest, since the public spotlight will turn to the courtrooms, in which a significant number of cases are ongoing, which were at the center of the public dialogue in the previous period.</p> <p> < p>Cases with political, economic and social impact are expected to be decided within the next judicial year, which officially begins in September.</p> <p>Specifically, before the Supreme Court in September will be the case of the request of the Attorney General, Giorgos Savvidis, for the suspension of the Auditor General, Odysseus Michaelides, the appeal of the medical examiner, Panikos Stavrianos, who is attempting to annul the conclusion of the third death investigation for the 26-year-old national guard, Thanasis Nikolaou, but also the reference of the Law by the President of the Republic Nikos Christodoulidis, which provides for the control of the assets of the Attorney General and the Assistant Attorney General.</p> <p>Besides, two other cases are taking the path of justice. This is the case of the Holy Monastery of Saint Avvakoum, in Fterikoudi, as well as the criminal case, which concerns both the report of the journalistic network “Al Jazeera”, and events in the context of the exceptional naturalization of foreign investors and businessmen, based of the conclusion prepared by the Myron Nicolatos Committee.</p> <p>The two cases, which will be before the Nicosia Criminal Court in September, are considered to be of major importance, since they fall under the most serious of the criminal code.</p> <p> < p>At the same time, another legal battle is going on, concerning the ecclesiastical life of the place.</p> <p>This is the ecclesiastical trial before the six-member Synod Court, where the Archimandrites, Nektarios and Porphyrios, on holiday, will try to prove that they are not involved in the financial and sexual scandals attributed to them.</p> <p><b>Case of suspension of General Auditor</b></p> <p>In the final stretch, the hearing will be before the Council of the Supreme Court, regarding the request of the Attorney General, Giorgos Savvidis, for the suspension of the Auditor General, Odysseus Michailidis.</p > <p>The decision is expected to be issued in September, without the date yet being announced.</p> <p>During the hearing, which was held from the end of June until the middle of July 2024, the two sides fought a fierce battle. , in order to convince the Council that based on specific facts there was or was not inappropriate behavior, with the Council reserving to announce its decision within September.</p> <p>Scenarios for what the Council's decision will be give and take, however, it would not be safe for anyone to predict what the final decision will be.</p> <p><b>Thanasis Nikolaou Case</b></p> <p>Also, the case of the 26-year-old national guard Thanasis Nikolaou, which is expected to signal new developments from September, is also a decisive decision from many points of view, since the decision of the Supreme Court is pending, in relation to the appeal of the medical examiner, Panikos Stavrianos, who attempts to annul the conclusion of the third death investigation for Thanasis Nikolaou, which states that the death of the unfortunate national guard was caused by strangulation and not by a voluntary fall from a height.</p> <p>Specifically, on September 10th they are going to before the Plenary Session of the Supreme Court, all sides, so as to be given instructions for hearing and taking their positions.</p> <p>During the last hearing the lawyers of the family of Thanasis Nikolaou spoke of “many and historical events”.</p> <p>The Legal Service was represented by the Assistant Attorney General, Savvas Angelidis, and the lawyers Elli Papagapiou and Christia Kythraiotou. Mr. Angelidis stated that the Attorney General of the Republic will not object to the medical examiner's request, regardless of whether the Legal Service “identified serious legal errors” in the conclusion of the Court of First Instance.</p> <p>The lawyer of the family of Thanasis Nikolaos, Nikos Cleridis, referred to the attitude of the General Prosecutor, both in relation to the case in general and during the death investigation. Mr. Cleridis spoke of a “conflict of interest”, saying that the position of the Attorney General has become clear during the death investigation.</p> <p>He said that his position is that in this case, but also during the death investigation , the Legal Service “passionately supported” the position that the conclusion of the applicant (Panikos Stavrianos) was the right one and, in fact, the Legal Service itself – it argued – was speaking as an independent institution and not as an accusing Authority.</p> <p>The third death investigation closed on May 10, 2024, with death investigator Doria Varosiotou having the sole say on the causes of death of the unfortunate national guard. The coroner, after a trial that lasted more than six months, announced her decision regarding the causes of death of the unfortunate Thanasis, which states that his death came from strangulation.</p> <p>It is noted that in the event that the Supreme Court annuls the conclusion of the coroner, then a fourth coroner's inquest will begin, putting the family in new legal adventures. If, however, the opposite happens then criminal investigators take over the reins, to conduct investigations.</p> <p><b>Abbakum Monastery case</b></p> <p>Another case, which is fundamentally the Cypriot church, is expected to take the path of justice.</p> <p>Specifically, the two Archimandrites of the Holy Monastery of St. Avvakum, in Fterikoudi, Nektarios and Porphyrios, were referred to a direct trial at the Criminal Court of Nicosia, on September 27, 2024.</p> <p>The two Archimandrites were accused in the District Court of Nicosia and they were released on parole.</p> <p>The defendants face 19 felonies. Specifically, they are accused of conspiracy to commit extortion, theft, money laundering, false tax declaration and act that may affect a police investigation.</p> <p>The indicting Authority requested Archimandrite Nektarios to sign a guarantee of €100,000 with one or more worthy guarantors. His name to be placed on the list prohibited from exiting the Republic and to surrender all his travel documents. He also asked to appear at a police station of his choice twice a week.</p> <p>For Archimandrite Porphyrios, the same conditions were requested, with a difference in the amount of the bail, which amounts to €50,000.</p> <p> < p>The key prosecution witness in the case will be Metropolitan Tamasou Isaias, with the witness list including 71 persons, including believers and priests who claim to have been deceived.</p> <p><b>Ecclesiastical trial</b> </p> <p>The Archimandrites on holiday, Nektarios and Porphyrios, are ready to fight to the end during the ecclesiastical trial that is to begin on August 30, 2024, before the six-member Synod Court.</p> <p> The process will begin on August 30 and is expected to be completed within the first fortnight of September.</p> <p>On the 30th of the month, at 09:00, the Metropolitan of Tamasos and Orenis Isaias was summoned to testify, while on September 4, 2024, three other persons from the sixty, who were included in the list of witnesses and who testified before the Investigative Committee, were summoned.< /p> </p> <p>In addition to the defendants, Hieromonk Barnabas has also been summoned before the Synodal Court, for whom recently the Archimandrites Nektarios and Porphyrios, who are on holiday, raised the issue of unreliability.</p> <p>It is noted that the indictment has been served by the ecclesiastical prosecutor. to the accused, with their lawyers having already started preparing their statement before the Synodal Court.</p> <p>The same information states that in addition to Archimandrites Nektarios and Porphyrios, who are on holiday, the monk Abvakum, the who faces the same charges.</p> <p>However, the penalty he faces is not the same, i.e. that of removal, but that of disaffiliation.</p> <p>Furthermore, for its part, the Police has investigated or is investigating twelve cases related to the scandal of the Holy Monastery. Saint Avbakum.</p> <p>Specifically, the one concerning the concealment of church property and specifically the amount of money found in the safe, which amounts to 807,000 euros and is a donation product, has already been registered in the Court, while since the beginning of July they have been before the Legal Service for study and instructions for nine cases, concerning the Abvakum Monastery.</p> <p>Also, that the Police are still investigating two cases concerning complaints by monks against the Metropolitan, attacks on persons who have seen the light of day and sexual offenses. </p> <p><b>Al Jazeera case</b></p> <p>Once again before the Permanent Criminal Court of Nicosia will be the three defendants in the criminal case, which concerns both the report of the journalistic network “Al Jazeera” and events in the context of the exceptional naturalization of foreign investors and businessmen, based on the conclusion prepared by the Nicolatos Committee.</p> <p>The high-profile case is set to begin on October 7, 2024, at 09:00.</p> <p>Accused in the case are the former Speaker of the House of Representatives, Dimitris Syllouris , the former Member of Parliament of AKEL, Christakis Giovani and one of the directors of Mr. Giovani's company, Antonis Antoniou.</p> <p>All three are facing charges related to the offenses of conspiracy to subvert the Republic and influencing a public official in violation of the Law ratifying the Council of Europe Convention on the Criminalization of Corruption.</p> <p>It is noted that the lawyer Andreas Pittatziis, who was one of the defendants, was acquitted on October 11, 2023 of the indictment.</p> <p>The continuation of the case before the courtroom will now continue with Andreas Pittatziis appearing as the lawyer of the defendant, Antonis Antoniou.</p> <p>It is recalled that the Nicosia Criminal Court proceeded in June 2023 to suspend the specific criminal case, the which was subsequently re-registered.</p> <p>The case had been withdrawn, due to the change in the composition of the Court, after the appointments of the Judges of the newly established Court of Appeal were announced on January 30, 2023, among whom was the then President of the Criminal Court, Stavros Stavrou.</p> <p>The The Court of Appeal assumed duties from July 1, 2023.</p> <p>The case was initially registered in mid-July 2022 at the Nicosia District Court, with the aim of referring it to the Criminal Court.</p> <p>The investigation ordered by the Attorney General, Giorgos Savvidis, after the revelations of the Al Jazeera network video, lasted more than a year and extended abroad, where statements and evidence were obtained.</p> <p>Also, thousands of electronic messages found on the computers of the persons under the category were examined.</p> <p>The publication of the disputed video in October 2020 by the Al Jazeera network led to the withdrawal of the Cyprus Investment Program by the Government.</p> <p> p> </p> <p><b>Pothen Esches Law</b></p> <p>Another legal battle is expected to take place before the Supreme Court between the House of Representatives and the President of the Republic, Nikos Christodoulidis. </p> <p>It is about the reference to the Law, which was voted in favor on July 11 by the Parliament and provides for the control of the assets (Pothen Esches) of the Attorney General and the Assistant Attorney General.</p> <p>The case was set before the Supreme Constitutional Court for instructions, on September 4, 2024.</p> <p>In particular, the President of the Republic proceeded to refer to the Supreme Constitutional Court the law, which concerns the Inheritance of State Officials, which was passed after relevant proposals of the Parliamentary Institutions Committee.</p> <p>With the law, the Parliament introduced arrangements for the obligation to submit the declaration of assets electronically by the liable official or the publicly exposed person.</p> <p>The declaration of assets also includes a statement of assets and liabilities of the personal and professional property, inside and outside the Republic, of the debtor person, which is prepared at cost prices and includes the assets of his/her spouse or partner and dependent family members. </p> <p>A separate annex is created in the law with specific officials and publicly exposed persons, who will make a declaration of no involvement.</p> <p>To these persons are added the Attorney General and Assistant General, the director of Press Office of the President of the Republic and the Presidents and Vice-Presidents of the Provincial Self-Governing Organizations.</p> <p><noindex></p> <div class=Source: politis.com.cy
