The case concerns the accidents in Indonesia in 2018 and in Ethiopia in 2019 with a total of 346 dead – The company had paid $2.5 billion to settle, but it is accused of violating the terms

The US Department of Justice is considering bringing prosecution against Boeing over two crashes involving 737 Max aircraft. The accidents, one in Indonesia in 2018 and the other in Ethiopia in 2019, killed a total of 346 people.

The airline giant violated the terms of an agreement reached in 2021 that shielded the company from criminal charges related to the incidents, the US Department of Justice said. The company itself has denied breaching the agreement.

The aircraft manufacturer failed to “design, implement and enforce a compliance and ethics program to prevent and detect violations of US law throughout its operations,” the US Department of Justice said.

Boeing said it looks forward to the opportunity to respond to the Justice Department and “believes it has honored the terms of this settlement.”

As part of the deal, Boeing paid a $2.5 billion settlement, while prosecutors agreed to ask the court to withdraw the criminal prosecution after a period of three years.

Boeing has until June 13 to respond to the allegations by the US Department of Justice.

The relatives of the victims have requested criminal action against the company.

“This is a positive first step, and for the families, that was overdue. But we need to see further action from the Justice Department to hold Boeing accountable,” Paul G Cassell, an attorney for the victims' families, said in a statement.
