Kenneth Smith to be executed Thursday
The US Supreme Court rejectedtodayappeal seeking to prevent authorities in Alabama from proceeding with the first execution of a death row inmate in the country by administering nitrogen gas.
The appeal concerned convicted murderer Kenneth Smith, whosea scheduled 2022 execution was aborted at the last minutebecause an IV attempt failed before the warrant expired.
The federal high court rejected the lawyers' argument that a second execution attempt, after Smith survived the previous – painful for him – attempt, would constitute a violation of the 8th Amendment of the US Constitution, which covers the ill-treatment of prisoners.
Therefore, the execution of the death row inmate Kenneth Smith will take place tomorrow Thursdaywith the administration of nitrogen gas.
