It is obliged to submit a new application to the Supreme Court regarding the law passed yesterday, it states in an announcement of the Audit Service.
Specifically in its announcement the EV states that “on May 9, 2022, with its announcement, the Audit Office had informed about the submission of an application to the Supreme Court, in accordance with the provisions of Article 139 of the Constitution, requesting a statement from the Court that the circular of the Ministry of Finance dated. 19.4.2022 is invalid from the beginning and without any absolutely legal effect. The circular stipulated that the titles of the latter in the Legal Service, the Audit Office and the General Accounting Office would not be those provided for in the Constitution.

He notes that, “The case is pending before the Supreme Court, the Council of Ministers included in the bill of the Supplementary Budget a provision similar to the said Circular, which yesterday the House of Representatives passed a law. & Nbsp; The Audit Office remains in the position that the determination of the title of the latter to place it in the Audit Office in clear contradiction with the explicit provisions of the Constitution, constitutes a constitutional deviation. & Nbsp; & nbsp; The Constitution has appointed the Supreme Court as its guardian, in which the issue that arose with the circular of the Ministry of Finance has already been brought. Finally, it notes that,” unless and until the new law is declared unconstitutional by the Supreme Court or otherwise the issue that has been decided by the Supreme Court, the new law will be implemented during the exercise of their constitutional powers by the Audit Office and the Auditor General, as well as by the staff of the Office “.
