Complaint against the companies Petrolina (Holdings) Public Ltd, EKO Cyprus Ltd, Coral Energy Products Cyprus Ltd and ExxonMobil Cyprus Ltd. The Nicosia and Kyrenia District Committee of the All-Cyprus Association of Liquid Fuels filed today before the Competition Protection Committee for alleged violations of the 2022 Protection of Competition Law.
According to a statement from the association, the complaint concerns a violation of Article 6(1)(a) of the Law due to the application of unfair wholesale prices for liquid fuels which manifested itself in excessive pricing by the complainants at stations bearing their trademark and/or marks and violation of article 6(1)(a) of the Law due to the application of unfair prices manifested by profit margin compression by EKO, Petrolina and Coral.
It also refers to a violation of article 6(1 )(c) of the Law due to the application of unequal terms on equivalent transactions by EKO and/or article 6(1) of the Law due to preferential behavior demonstrated by EKO in favor of a specific company or a company with the same interests as it and/or the shareholders of this, with the result that gas station owners who manage neighboring gas stations with the “EKO” brand are put at a competitive disadvantage.
Furthermore, a violation of Article 3 of the Law is reported by the above companies due to the prohibition of mutual supplies between gas station owners who manage gas stations with the same brand and/or other suppliers or resellers of the relevant products of the Complainants, as well as a violation of Article 3 of the Law by Petrolina due to the imposition of a non-proportional non-competition clause in its agreements with gas station operators with its commercial signals.
