Auxiliary models of General and Special Power of Attorney, posted on its Internet Portal (Cadastre Portal), the Cadastre Department of Land Surveying (TCX), as part of its efforts to continuously improve the quality of service and information to citizens, as stated in KYPE the Director of the TKH Elikkos Ilias.
The Director of the TKH said that “the absence of samples created a vacuum and inconvenience for ordinary citizens” and added that “for their convenience, the samples have been posted in the form of a Word document, so that citizens can edit them and/or vary their content as they wish, depending on the case”.
He noted that the samples of the Special and General Power of Attorney can be found in the “Cadastre Portal” – “Portal for Citizens” – “Citizen's Guide” or “Application Forms”, at the addresses: https://portal.dls.moi.gov. cy/el-gr/Odegios%20tou%20Politis/Pages/SAMPLES%20GENERAL%20AND%20SPECIAL%20POWER%20DOCUMENT.aspx or https://portal.dls.moi.gov.cy/el-gr/application-forms/Pages/default.aspx
He stated that these documents are listed as auxiliary models and the Department of Cadastre and Land Surveying is not responsible for their use.
“However, it was decided that they are very useful for the citizens and will facilitate them in their legal actions in the Department”, he added.
Mr. Ilias urged the citizens , before signing any General or Special Power of Attorney Document , to be particularly careful in relation to its content and to be aware of the consequences created by signing this document.
“Those who sign a power of attorney must do so of their own free will, be of sound mind, of mental and spiritual sobriety, and generally not subject to any legal exception regarding their legal capacity,” he emphasized.
In addition, he stated that they should have detailed information and sufficient knowledge on the subjects, to which the power of attorney refers.
The Director of the TKX also told the KYPE that the authenticity of the signature of the Power of Attorney in any General or Special Power of Attorney Document, should be duly certified by a certifying officer, in the presence of the customer, in accordance with the provisions of the Annex of Law 165 I)/2012.
In addition, he stated that the document on which the signature or seal is certified by the certifying official should be stamped, in accordance with article 34 of the Paper of Law no. 19 of 1963 and the Amending Laws 38/72 and 173/(Ι)/2012.
