Following the acquittal of the former Metropolitan of Kiti Chrysostom for the decision of the Permanent Criminal Court of Larnaca in the accusation of rape of a woman 16 years ago, the complainant proceeds to a civil lawsuit claiming damages.
Speaking on the Control Panel show of POLITIS 107.6, the lawyer of the complainant Christos Triantaphyllides, explained that this is a separate procedure, which will be addressed by another Court, which due to the civil nature of the case, applies a different measure of proof than that of the Criminal Court. guilt must be proved beyond any reasonable doubt. During the trial of the civil case, the validity of the complaint of the complainant will be judged again, taking into account the lapse of 16 years from her alleged rape.
With additional witnesses
Mr. Triantaphyllides stated that he intends to present to the Court three witnesses, whom the Criminal Court did not summon. This is the journalist who was interviewed by the complainant, the MP during the given period, who accompanied her to the Archdiocese to make a complaint to the Archbishop and the Archbishop of Cyprus Chrysostomos himself, who heard the complainant when he met her at the Archdiocese.
The steps of the Legal Service
Regarding the decision of the Criminal Court, Mr. Triantaphyllides said that it is fully respected, indicating at the same time that this is a first instance decision and it is currently up to the Legal Service that was responsible for proving the guilt of the accused, to study the decision and everything. the data and decide whether to appeal to the Supreme Court.
It is noted that the former Metropolitan of Kiti Chrysostomos is facing another accusation, that of sexual harassment of a minor by another complainant, again several years ago, a case which is scheduled for trial in the Criminal Court in January 2022.
